Data Processing Agreement.

This page explains, in plain language, how TextGopher™ processes personal data on behalf of the businesses that use it. It forms part of our Terms. A countersigned DPA for your records is available on request at privacy@textgopher.com.
Roles & scope
For personal data about callers and customers that flows through TextGopher™, the business using the service is the controller and TextGopher™ is the processor. We process that data only to provide the service, and only on the controller’s documented instructions — which include the settings and rules you configure in your account.
Nature & purpose of processing
We process personal data to recover missed calls and organize opportunities: responding to a caller by text on your behalf, understanding the request, and creating a structured record you can act on. Processing lasts for as long as your account is active, plus the retention periods described below.
Categories of data & data subjects
Data subjects: the callers and customers who contact your business. Data: phone numbers, message content, names and details a caller chooses to share, call metadata, and the opportunity records created from them.
Processing on your instructions
We act on your instructions and don’t use caller data for our own purposes. We never sell it, and we don’t share it for anyone else’s marketing. Our personnel are bound to confidentiality.
Security measures
We maintain technical and organizational measures appropriate to the risk — including per-tenant isolation, encrypted credentials, signature-verified webhooks, parameterized data access, and an append-only audit trail. These are described on our Security page.
Subprocessors
You authorize us to engage the subprocessors listed on our Subprocessors page. Each is bound to data-protection obligations consistent with this agreement, and we update the list before a new subprocessor begins handling customer or caller data.
Assisting with data-subject requests
If a caller exercises a privacy right (such as access or deletion), we assist you in responding — taking into account the nature of the processing and the information available to us. See Your Privacy Rights.
Personal data breach notification
If we become aware of a personal data breach affecting data we process for you, we will notify you without undue delay and provide the information you reasonably need to meet your own obligations.
Return & deletion of data
We retain personal data per our retention policy and delete or return it on termination of your account, except where we are required to retain it (for example, records that must outlive a conversation to meet messaging-compliance obligations). To request deletion, contact privacy@textgopher.com.
